This Data Protection Statement applies to the operation of the website www.digitalbarrierefrei.at and the processing of personal data via this website.

Complaint Form / Complaints Office

Scope of data processing

The Complaints Office will process the following personal data when handling and processing complaints filed under the Web-Zugänglichkeits-Gesetz. The scope of the processing may vary depending on the complaint.

Complainant:

  • Last name, first name
  • Email address
  • Phone number and other contact details (where provided on a voluntary basis)
  • Other personal details depending on the content of the complaint (where provided on a voluntary basis)
  • Health information (where provided on a voluntary basis)

Contact at the entity concerned:

  • Last name, first name
  • Company name, related organisation, related organisational unit
  • Email address or other contact details
  • Attributable websites and apps

Legal basis of data processing

The legal basis for this processing is Article 6(1)(c) GDPR in conjunction with section 5 of the Web-Zugänglichkeits-Gesetz (WZG), Federal Law Gazette I No. 59/2019 as amended, insofar as no special categories of personal data within the meaning of Article 9(1) GDPR are processed.

If special categories of personal data within the meaning of Article 9 GDPR (e.g. data concerning health) are transferred to FFG as part of the complaint, such data will only be processed to the extent necessary for the complaint procedure.

In this case the lawful basis of the processing is the substantial public interest within the meaning of Article 9(2)(g) GDPR in functioning and effective enforcement proceedings aimed at ensuring digital accessibility of the websites and apps of the federal government and its institutions for the benefit of the Austrian population.

The necessity for such enforcement proceedings can be derived directly from Directive (EU) 2016/2102 on the accessibility of the websites and mobile applications of public sector bodies which support the member states of the European Union in meeting their national obligations concerning the accessibility of websites and implement the member states’ commitment to the UN Convention on the Rights of Persons with Disabilities with regard to the websites of public sector bodies.

Purpose of data processing

The purpose of the processing is handling and documenting complaints under section 5(1)(1) WZG.

FFG shall accept and examine complaints concerning infringements of the provisions of the Web Accessibility Act by the federal government or institutions attributable to it, in particular, deficiencies regarding conformity with accessibility requirements.

Data retention period

Your personal data will be stored for the duration of the complaint proceedings and will be deleted within six months of the last communication regarding the respective complaint at the latest.

Data recipients

If an infringement of provisions concerning the equal treatment requirement set out in federal laws is identified in the course of the complaint proceedings, the complaint may, pursuant to the provisions of the Web Accessibility Act, be passed on to the respective institution competent for complaints of data subjects in accordance with these provisions (e.g. Disability Ombudsperson or Ombud for Equal Treatment).

Data may be transferred to processors acting on behalf of the FFG (e.g. IT service provider) within the limits of the contracts they carry out for the FFG.

Other than that your personal data will not be passed on to third parties without your consent.

Tracking on the website (Matomo)

Scope of data processing

Matomo is used for analysing website usage and various data are collected via cookies.

The data collected and processed include but are not limited to the following:

  • (Shortened) IP address
  • Browser
  • Country/Region
  • Time spent on the website
  • Pages visited on the website
  • Interactions with the website

The data are subsequently anonymised by the FFG. It is generally not possible for FFG to draw conclusions about individual users.

Legal basis of data processing

If you have given your consent to the setting of cookies, the legal basis is your consent in accordance with Article 6(1)(a) GDPR.

Purpose of data processing

The purpose of processing is to analyse website usage. The data is used to analyse the use of the website and to compile reports on website activity.

Data retention period

The processing results are stored for a period of 180 days. For more information on the storage period of the individual cookies, please see the Cookie Policy.

Data recipients

Matomo is hosted by FFG itself. Personal data will not be passed on to third parties.

Posting YouTube videos

We use the YouTube.com platform to post our own videos and make them publicly accessible. YouTube is a service provided by a third party not affiliated with us, namely Google Ireland Limited or Google LLC.

Scope of data processing

We embed videos stored on YouTube directly on our website. This means that content from the YouTube website will be displayed in parts of the browser window.

We use YouTube Nocookie to ensure that the videos embedded on our website do not contain tracking cookies.

However, the YouTube videos can be viewed by clicking on them separately. If you view a (sub)page of our website on which YouTube videos are embedded in this form, a connection to the YouTube servers will be established and the content displayed on the website by notifying your browser.

In this case, certain personal data (e.g. IP address, browser details, metadata) will be transmitted to YouTube.

If you follow a YouTube link, we would like to point out that YouTube stores its users' data (e.g. personal information, IP address) in accordance with its own data usage guidelines and uses it for commercial purposes.

Legal basis of data processing

We only establish a connection to YouTube if you have consented to this. The legal basis is your consent in accordance with Article 6(1)(a) GDPR.

Another possible legal basis is FFG's legitimate interest pursuant to Article 6(1)(f) GDPR, which consists of providing users with the desired and requested content in a targeted and efficient manner.

Purpose of data processing

The purpose of the data processing is to provide content via the YouTube platform.

Data retention period

The FFG will delete personal data as soon as the purpose of storage and processing ceases to apply, unless there is a legal obligation to retain it for a longer period.

Data recipients

The service provider of YouTube in Europe is Google Ireland Limited, a company based in Ireland.

However, personal data may also be transmitted to its parent company Google LLC. This company is based in the United States of America (USA).

The European Commission has issued an adequacy decision for the USA in accordance with Article 45 GDPR ("EU-US Data Privacy Framework"). Google LLC is certified according to the "EU-US Data Privacy Framework".

The legal basis for the processing is FFG's legitimate interest pursuant to Article 6(1)(f) GDPR. The legitimate interest is to make the website accessible to the public and to be able to carry out the processing necessary for the general operation of the website.

Newsletter

Legal basis of data processing

FFG will obtain your consent for the processing of the data when signing up for the newsletter; the legal basis is therefore Art. 6 (1)(a) GDPR.

Purpose of data processing

We will process your contact details to send you the newsletter for which you signed up.

Data retention period

Your data will be stored by the FFG for as long as you receive the newsletter. The data will be deleted 4 months after cancellation of the newsletter.

Data recipients

We use a marketing service provider (SendInBlue GmbH) as a processor for the purpose of sending the newsletter. The processor also has access to personal data on our behalf and in accordance with our instructions in order to be able to provide the commissioned services.

In all other cases, FFG will only transfer the data to third parties if this is required by law or if the data subject has consented to the transfer.

Rights of the data subject

Right to access

You have the right to access your personal data processed by the FFG.

Right to rectification and right to restriction of processing

You may request the rectification of inaccurate data or completion of incomplete data.

You may, under certain circumstances, demand restriction of processing to the extent that such data may only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest.

Right to data portability

You may demand that the FFG transmits to you - or if technically feasible to a third party indicated by you - a copy of your data in a structured, commonly used and machine-readable format.

In addition, you have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.

Right to erasure

Under certain circumstances, you have the right to obtain erasure of your data, e.g. if your data is not processed in accordance with data protection requirements.

If you have asserted your right to rectification, erasure or restriction of processing vis-à-vis the FFG, we are obligated to communicate such rectification or erasure of data or restriction of processing to each recipient to whom your personal data have been disclosed, unless this proves impossible or involves disproportionate effort.

Right to object

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Article 6(1)(f) GDPR.

Right to withdraw declaration of consent under data protection law

You have the right to withdraw your declaration of consent at any time. The withdrawal of consent shall not affect the lawfulness of any consent-based processing performed until the withdrawal.

Supervisory authority

You shall have the right to lodge a complaint with the national supervisory authority in your place of residence if it is assumed that the processing of personal data is carried out unlawfully.

In Austria, this national supervisory authority is the Data Protection Authority (https://www.dsb.gv.at/).
